Fred W. Bopp III

Associate Attorney

Fred has been practicing law since 1989. He is admitted to practice before the state and federal courts in Maine, New Hampshire, and Massachusetts and has appeared before the bankruptcy courts in the Districts of Maine, Massachusetts, New Hampshire, Illinois, and New York. Fred graduated from Dartmouth College with a degree in History and then from Vanderbilt University School of Law. He practiced with a law firm in Portland, Maine before coming to Holman, Howard, Bopp & Guecia in 2018. Cecilia and Fred formed Bopp & Guecia in January of 2019.

Fred’s practice has focused on significant complex commercial civil litigation (representing both plaintiffs and defendants), the pursuit and enforcement of creditors’ and debtors’ rights and remedies, real estate and landlord-tenant disputes, bankruptcies, reorganizations, insolvencies, liquidations, financial restructurings, workouts, receiverships, construction/contractor disputes, sales, contract review and negotiations, workouts, appeals, arbitrations, mediations, and related matters and proceedings. He is a longstanding trusted legal advisor to individuals and businesses in a wide range of engagements, both in and out of state and federal court, including numerous financial institutions, secured and unsecured creditors in bankruptcy cases, receivers, business owners, buyers of real estate, landlords, tenants, parties involved in litigation, acquirers of assets, healthcare and benefits administrators, manufacturers, Chapter 11 Creditors’ Committees, Chapter 7 bankruptcy trustees (in Maine and Massachusetts), and debtors in bankruptcy. Fred has considerable experience representing clients in preference, fraudulent transfer, and director and officer litigation, relief from stay, allowance of claims, § 363 and receivership sales, Chapter 11, 12, and 13 plan confirmation, contract negotiations, and other bankruptcy and non-bankruptcy matters. He also serves as a mediator and arbitrates disputes as a member of the American Arbitration Association National Panel.

Fred is AV Peer Review rated for Legal Ability and Ethical Standards by Martindale-Hubbell and his peers have selected him for inclusion in The Best Lawyers in America since 2005 in the fields of Bankruptcy and Creditor Debtor Rights/Insolvency and Reorganization Law and Litigation – Bankruptcy.

Fred is a member of the Cumberland County, Maine (Member: Sections of Bankruptcy & Reorganization, Consumer & Financial Institutions Law, Federal Practice, Litigation, and Solo & Small Firm), New Hampshire, and American Bar Associations (Member: Sections of Business Law, Litigation, Law Practice Division, and Solo, Small Firm and General Practice Division) and the American Bankruptcy Institute. He is also a Maine Bar Foundation Fellow and a Co-Trustee of the Bopp Family Charitable Foundation.

Fred and his wife live in Falmouth, Maine with their three sons. Fred is a foodie who enjoys a good meal, can regularly be found playing softball and pickleball, and is an avid boater and pinball enthusiast.
